Gharfolio ("we", "us"). These terms apply to your use of Gharfolio, a service that lets property brokers and agencies run their own website. By creating an account or using the service, you agree to them.
Your account
- You must be at least 18 and use the service for your property business.
- Give accurate details and keep them up to date.
- Keep your password private. You are responsible for activity on your account.
- We may review new accounts before they can be used or published.
Free trial and plans
New accounts get a free trial of 15 days with full access. When the trial ends, your dashboard and website are paused until you choose a paid plan. Your content is kept.
What each plan includes is shown on our pricing page. Fees are as shown there or as agreed with you in writing. Unless we agree otherwise, fees already paid are not refunded for part of a billing period. If a payment is not made, we may pause your account.
Your content
You own your profile, listings and photos. You give us permission to store, process and display them so we can provide your website. This permission ends when you delete the content or your account.
You confirm that you have the right to publish everything you upload, that your listings are accurate and not misleading, and that you comply with the laws that apply to you, including the Real Estate (Regulation and Development) Act, 2016 and your state's RERA rules where they apply.
Your website visitors
Enquiries from your website come to you. You are responsible for handling your visitors' personal data lawfully. Each website includes a privacy policy you can complete in your dashboard.
What you must not do
- Publish false, misleading or unlawful listings or content.
- Upload content you do not have the rights to.
- Send spam or use the service to harass anyone.
- Try to break, overload or gain unauthorised access to the service or other accounts.
- Copy or resell the service or its templates.
Suspension and closing your account
We may suspend or close an account that breaks these terms, has unpaid fees, or puts the service or others at risk. Where we can, we will tell you why and give you a chance to fix it. You can ask us to close your account at any time.
The service
We work to keep the service available and secure, but it is provided as it is and as available. We may change or improve features. The service, its software and its templates belong to us. You may use them only while your account is active.
Liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost business or profits. Our total liability to you is limited to the fees you paid us in the 12 months before the claim. You agree to compensate us for claims caused by your content or by your breach of these terms.
Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change is significant, we will tell registered brokers before it applies.
Governing law
These terms are governed by the laws of India. Courts at India have jurisdiction over any dispute.
